Members of the pro-life movement standing outside the Supreme Court on Monday were visibly discouraged by the 5-3 decision striking down a Texas law that imposed health and safety regulations on abortion clinics. But those activists showed no signs that they intend to back down from the battle over abortion in the United States.
"The pro-life generation is stronger than ever before," Maddie Schulte, a regional coordinator at Students for Life, told The Daily Signal outside the Supreme Court in Washington, D.C. "I'm excited to see what comes next. We're coming back full force."
"We believe in life," added Anja Scheib, a programs intern for Students for Life. "Millennials," in particular, she said, "are becoming more pro-life."
The case before the Supreme Court, Whole Woman's Health v. Hellerstedt, involves a Texas law, known as H.B. 2. The law required abortion facilities to meet the same health and safety standards as other facilities performing similarly invasive surgeries. It also required physicians who perform abortions to have admitting privileges at local hospitals, in the event that something went wrong during an abortion procedure.
The Supreme Court has previously ruled that while abortion is legal in the United States, states are allowed to regulate the procedure as long as those regulations don't pose an "undue burden" on women's ability to get an abortion.
With Monday's 5-3 decision, the justices decided that the medical benefits of Texas' law did not justify the burdens they impose on clinics.
In issuing the majority opinion, Justice Stephen G. Breyer cited a district court's findings that concluded enforcement of the admitting-privileges requirement forced almost half of Texas' 40 licensed abortion clinics to shut down. If the surgical-center provision were allowed to take effect, the lower court added, the number of abortion facilities would be reduced further, so that "only seven facilities and a potential eighth will exist in Texas." 
On the basis of these findings, among others, Breyer wrote:
We conclude that neither of these provisions offers medical benefits sufficient to justify the burdens upon access that each imposes. Each places a substantial obstacle in the path of women seeking a previability abortion, each constitutes an undue burden on abortion access, and each violates the federal Constitution.
Breyer was joined by Justices Ruth Bader Ginsburg, Elena Kagan, Anthony M. Kennedy, and Sonia Sotomayor. Dissenting were Chief Justice John G. Roberts Jr. and Justices Samuel A. Alito Jr. and Clarence Thomas, who said the decision "exemplifies the court's troubling tendency 'to bend the rules when any effort to limit abortion, or even to speak in opposition to abortion, is at issue.'"
Monday's decision is likely to affect other states with similar laws regulating health and safety standards for abortions. According to the Center for Reproductive Rights, more than 20 states have laws that impose health and safety standards on abortion clinics, although not all are as strict as the Texas law.  
Virginia is one of them.
"I had to be here to witness this," Rebecca Gotwalt of Virginia told The Daily Signal. Gotwalt, who identifies as pro-choice, arrived at the Supreme Court a little after 7 a.m.
"I know we're repealing our TRAP [Targeted Regulation of Abortion Providers] laws in Virginia, so it was very important to see the Supreme Court do this on the national level, so individual states will stop punishing women."
Supporters of the Texas law said it was an attempt to improve the health and safety standards for women seeking abortions.
The law was enacted after the 2013 murder conviction of Dr. Kermit Gosnell, a Philadelphia abortionist who is serving a life sentence. The trial established that poor health and safety standards at Gosnell's clinic led to the deaths of multiple babies who survived botched abortion procedures, along with the death of a mother—in part because paramedics could not get a stretcher into the building.  
"Abortionists shouldn't be given a free pass to elude medical requirements that everyone else is required to follow," Steven H. Aden, a senior counsel at the conservative Alliance Defending Freedom, said in a statement after the decision. He added:
We are disappointed that the Supreme Court has ruled against a law so clearly designed to protect the health and safety of women in the wake of the Kermit Gosnell scandal. The law's requirements were commonsense protections that ensured the maximum amount of protection for women, who deserve to have their well-being treated by government as a higher priority than the bottom line of abortionists. Any abortion facilities that don't meet basic health and safety standards are not facilities that anyone should want to remain open.
Opponents view the requirements as simply an attempt to abolish abortion in the U.S., and were pleased to see the law struck down by the court.
"In states across the country, we've seen TRAP laws shut them down," Amber Banks, director of programs and communications for NARAL Pro-Choice Maryland, told The Daily Signal. She added:
I remember when I was in college, I interned at the local Planned Parenthood ... because they had to have hallways a certain length and it mattered what their parking lot layout was. It just seemed really absurd because I know from talking to doctors and having doctors in my family, that that's not actually the kind of things that actually keeps people safe. It was just being used to force people to give billions of dollars for renovations or shut down.
Some supporters of the law, too, saw the case as part of bigger question of abortion in the United States.
"Abortion is—to me—an issue that is so near and dear to my heart and the hearts of millions of people across this country," Evan Stone of Louisville, Kentucky, told The Daily Signal. "It goes way beyond politics. We can disagree on taxes, immigration, whatever, but this is an issue that is central to who we are as a human civilization."
Stone, who is interning in Washington, D.C., this summer, said he spent the night outside the Supreme Court and started protesting at 6 a.m. Monday.
"Do we believe that human life has intrinsic value or not? That is the question at heart here," Stone said.

WASHINGTON – In a controversial ruling, the Supreme Court struck down a Texas law requiring physicians who perform abortions to have hospital admitting privileges. The law also requires clinics to meet hospital-like safety stands for outpatient surgery.
Hundreds awaited Monday as the dramatic day played out at the high court.
The issue: the abortion and Texas access law that closed all but a handful of clinics in the Lone Star State over failure to meet state health standards. In ruling against the Texas law, pro-life advocates say the court missed an opportunity to protect women.
"It's extremely disappointing to see five unelected and unaccountable justices make this decision that hurts women," said Arina Grossu, director for the Center for Human Dignity at the Family Research Council. "This case is about women's health and safety standards and they have refused to protect women. And this is going to mean that more women are going to continue to be hurt and even die in these abortion facilities."
Pro-choice advocates argue that facilities are safe enough and their concern is over access.
"I believe that the fact that the laws have made it so – there's so few abortion clinics – proves the fact that the laws are making a lower access to abortion versus making a safer abortion," one pro-choice advocate responded. "So I believe that access is really important and I'm really happy that we won."
Justices in the majority felt the Texas regulations pose an obstacle to women seeking abortions and could force women in dire circumstances to seek out unlicensed practitioners.
"Basically he said that these were new standards," Steve Aden, senior counsel with Alliance Defending Freedom, said. "He ignored the fact that they were consistent with the standards that [they] were applied by Texas to outpatient surgical facilities across the board, and he said they just simply closed too many clinics."
Lawyers for the Texas state law are discouraged by the ruling, but they think many clinics will remain closed because the overall demand for abortion is decreasing.  
"The reason that clinics are closing by and large across the country is because abortion is more and more unpopular. That's a wonderful thing," Aden said.
"We know that the majority of Millennials, my generation, the majority of college-aged women are pro-life and we're going to continue fighting for them," Jane Riccardi with Students for Life of America said.
The decision has spurred pro-choice groups to continue fighting for the lives of the unborn. They're planning to go after other states with strict clinic regulations.
"This is a rallying point for the presidential election," Concerned Women for America President Penny Nance said. "There are huge implications for the unborn in this next election and I call on every pro-life American to make sure they vote."
"We're going to work very hard to make sure we have better justices and overturn this decision," Nance said. "We're not done."
Pro-life leaders say this decision underscores the importance of electing a pro-life president in 2016 since the next president will appoint at least one new justice to the Supreme Court.

Biblically Accurate Noah’s Ark Measuring 300 by 50 Cubits Built in Kentucky

In two weeks, the doors to Noah’s Ark will open once again — but with a few key differences from the original Biblical story. This version of the “ark” is really an ark-like theme park in Northern Kentucky. Costing over $100 million, the park will be part entertainment and part religious education. Its owners established the Bible-themed park, called Ark Encounter, with the goal of convincing visitors that the Biblical story of the flood is a literal version of a historical event.
The new version of the ark was not intended to be a floating solution for divine flooding, since it has a concrete floor and is supported by concrete pillars anchored into the ground. Launching the ark would require a unique series of natural disasters culminating in a flood that engulfs landlocked Williamstown, Kentucky, 600 miles from the nearest beach. The ark is the showpiece for Ark Encounter, which educates visitors through elaborate exhibits and offers an adjacent Ararat zoo, zip lines, a 1,500-seat restaurant, and a gift shop.
The aptly named Ken Ham, president of Answers in Genesis (AiG), built Ark Encounter just a few miles from his Creation Museum, which attracts nearly half a million visitors a year and teaches a young Earth theory of creation. Ham is a powerful voice in his circle of like-minded Biblical literalists. Young Earth Creationism played an essential role in the ark project.
The reproduction of Noah’s naval wonder cost over $100 million and generated almost as much controversy as the original. The ark became the focus of controversy when, in 2014, Ham invited pop-scientist Bill Nye to debate the question, “Is Creation A Viable Model of Origins?” The scientific community was dismayed, claiming that by agreeing to the debate, Nye validated creationism, thereby handing a victory to Ham before any words were spoken.
The video was a viral sensation and Ham later announced that the publicity generated by the debate spurred fundraising, allowing the ministry to begin construction on the ark. Ham told the Lexington Herald Leader that the goal of the immense project was to show the true scope of Noah’s Ark, and that it’s possible to build a structure that could hold the 16,000 animals believers estimate survived the Biblical flood.
Even in the planning stages, controversy over the ark led to a prolonged court battle. The exhibit sparked concerns about separation of church and state after Governor Matt Bevin approved $18 million in tax breaks for the project, according to a report by Fox 17 Nashville.

Critics also objected to the park’s plan to hire only Christian workers. Potential employees must sign a “Statement of Faith” which disavows same-sex marriage, premarital sex and adultery. These conditions are acceptable for religious institutions, but AiG had applied to participate in the Kentucky Tourism Development Program. The conditions were approved after it was reasoned that the park was part of a religious institution and not a tourist attraction.In January, US District Court for the Eastern District of Kentucky upheld AiG’s right to religious preferences in its hiring while still qualifying as a toruist attraction.
Though it has its commercial aspects, it is clearly Biblically inspired. Touted by its creators as the world’s largest timber framed building, it adheres to the dimensions described in the Bible.
And this is how thou shalt make it: the length of the ark three hundred cubits, the breadth of it fifty cubits, and the height of it thirty cubits. Genesis 6:15
A Biblical cubit (ama in Hebrew) is the length from the elbow to the fingertips of an average man. The exact length is unknown, but it is generally accepted to be between 19.8 – 20.6 inches long. Based on this estimate, the builders of the reproduction made their ark 510 feet long, 85 feet wide, and 51 feet tall.
Logs up to 50 feet tall were harvested from as far away as British Columbia and Oregon. All together, 3.3 million feet of wood, or 612 miles’ worth of planks, were used in the ark. As for the builders, instead of Noah’s sons, Shem Ham and Japhet, the new ark employed 75 Amish craftsmen and hundreds of other workers who had to be trained in traditional woodworking, Ham said.
To commemorate the Biblical flood which inaugurated the original, the Kentucky ark will have extended hours for the first 40 days and 40 nights.
Mark Looy, co-founder of Answers in Genesis, told Chatanooga news site Nooga that future plans at the park include a replica of a walled city from 2300 B.C., the Tower of Babel, a first-century Middle Eastern village, a journey through history from Abraham to the parting of the Red Sea, and a walk-through aviary.
The ark replica is not the first to gain global attention as a tourist attraction. Another landlocked ark, located in Hong Kong, was built as a Christian creationist theme park. A floating replica, built by Johan Huibers in the Netherlands, is scheduled to sail 5,200 miles this summer from its berth in Norway to Rio de Janeiro. Earlier this month, a half-size replica Huibers built collided with a Coast Guard vessel in Oslo Harbor while being towed to a new location.

Israeli's Message to Orlando: 'We Weep With You'

Standing With Israel
Recently I visited with Christian friends from Orlando in Jerusalem. We connected some time ago and became immediate friends, sharing our respective faiths, reverence for God and love for Israel. They are frequent visitors, know Israel well and we are in touch often.
We've been planning an Israel solidarity event together and spent some time discussing details of date, timing, format and how to involve both Jews and Christians. We also spoke about our respective families, ministries and current events in Israel and the US.
The week they left, our respective communities were jarred with the awareness that we share much more in common than we would like. The Tel Aviv and Orlando terror attacks were unwanted wakeup calls.
Some nonsensical people commented after the Tel Aviv attack—leaving four dead and dozens wounded—that it was due to the "occupation."  This is absurd and provides a justification that any perceived wrong of Muslim extremist sensibilities (whether in Tel Aviv recently, or Paris a year and a half ago) is somehow OK or to be expected. I am still looking for that absurd justification for the Orlando terror attack. Maybe Mickey Mouse is nefariously occupying the Bat Cave.
Later, I was interviewed by a journalist who is delving into the root of what motivates Christian support for Israel. I explained that there were many factors but, simply, it is rooted in the biblical obligation to bless Israel. The fact that as this phenomena has grown in parallel to the rebirth and revival of Israel, fulfilling biblical prophecy, coupled with threats against Jews and Christians and overall western (but not exclusively) civilization, underscores the imperative for solidarity. It is a blessing indeed and exactly what God wants, that the two parallel but interrelated phenomena of the upsurge in Christians blessing Israel and increased solidarity between Jews and Christians has expanded, and continues to do so.
Unfortunately, the Tel Aviv terror attack and the Orlando attack underscore that need all the more. 
After Orlando, my son and I were talking and he asked why it was that nobody stopped it. How could it be that nobody inside the club attempted to disarm the terrorist? Why was it that there was nobody armed inside? How was it that fear overcame bravery?
From an Israeli perspective, as horrible as terror attacks are when they happen here, and they happen too often, at least we know that in most cases, the terrorist will be stopped and killed or captured in short order. My son didn't understand what seemed like an impotent response inside, coupled with what seemed like an unprepared police response outside, allowing the terrorist to go on and on, posting to Facebook, and taunting emergency services with calls to 911.
But know this, people of Orlando: We know the heartache of loss. We weep with you.
Security camera footage of the Tel Aviv attack showed one of the miraculous occurrences, tremendous bravery and selflessness amid the shooting. While restaurant patrons scurried for the exit and to take cover, an unarmed man rushed the one of the terrorists and knocked a gun from his hand. Doing so gave patrons more time to flee, and certainly saved more lives. 
I don't own a gun, but I always think of getting one. One of the motivating factors to do so is a terror attack that took place in Jerusalem in 2008. A Palestinian Arab terrorist, using the tractor that he was driving freely through Jerusalem for work, attacked and tried to overturn a school bus filled with kids. That summer, there were a few such attacks where terrorists used their construction equipment as weapons. At this one, an armed bystander climbed atop the tractor and shot the terrorist, disabling him and preventing any further harm to the children, or anyone else.
Honestly, I'd love to be in a situation where I am able to stop a terrorist like that, and hope that if put to the test, armed or not, I'd respond with similar bravery and selflessness.
Back to Orlando, a few years ago I was checking into the Orlando airport for a domestic U.S. flight. I have become accustomed to the long lines and delays as the TSA undertakes at least perfunctory precautions to prevent a terrorist from getting onto or near a plane. I remember going through security and being told I had been selected for a random additional security screening.
I let the TSA staff do what they needed to do, but told them I came from Israel, and not are they only wasting time stopping me randomly, but they are stopping someone from the one Middle Eastern country they can trust and which understands security precautions. I was polite, but told them firmly that they need to be profiling the terrorists, not stopping people randomly.
And it seems that if the FBI or others had taken the threat more seriously and profiled or investigated the terrorist in Orlando more thoroughly, they could have stopped him. Of course, critics will charge that profiling is not PC. But if it's between PC and survival, I pick survival.
A friend posted something on his social media in the wake of Orlando that was especially poignant and to which I replied. We got into a chat about it and he said how the U.S. has to learn so much more from Israel about how to respond to terrorist threats and prevent attacks. I replied that we are meant to be light unto the nations, but I don't think this is what God had in mind.
However, to the extent that in this way we can be, because of the common threat, the common enemy, and the necessary solidarity especially between Jews and Christians, I pray to the same extent that the world is threatened by Islamic terror as a common enemy, that if we can be a light unto the nations in this way too, so be it.
Among the theme parks in Orlando is The Holy Land Experience, owned by TBN. I've driven past but never been inside. I understand it portrays a sample of biblical life in Israel including a replica of the Temple and the traveling tabernacle. While people dressed as Roman soldiers mingle through the park, one thing I suspect it does not include is a sense of the many challenges to being a Jew that began with Abraham, continued in the Land, in exile and slavery in Egypt, and during and long after our return, subsequent exiles, and still today. 
One thing I have learned about living in Israel is that while God promised the Jewish people the Land of Israel as a timeless inheritance, He never promised that it would be easy or without its challenges. We live with and accept it, and no matter the challenges, we will overcome them because He continues to grant us His protection. 
I pray that God will change the hearts of the terrorists who are the enemies of Jews and Christians so that, together, we may worship Him according to our traditions, and continue to build on the growing trend of solidarity, not because of fear but because of simple biblical imperative.
