A Victory of Sorts for Undercover Pro-Life Activists Against 'Politically Motivated Prosecution'

A California court dismissed 14 of the 15 criminal charges against two pro-life undercover investigators with the Center for Medical Progress.
California Attorney General Xavier Becerra brought the charges against David Daleiden and Sandra Merritt for recording conversations they had with Planned Parenthood officials. Those tapes allegedly include discussions about the sale of aborted baby tissue and body parts by Planned Parenthood.
The Superior Court in San Francisco dropped the 14 charges, but left all of them open to amend. That means Becerra could change the charges and bring them again, or bring new charges against Daleiden and Merrit. The court also kept one charge against Merrit for allegedly conspiring to invade privacy.
Daleiden believes this legal battle has little to do with what he did, and everything to do with politics.
"This is a politically motivated prosecution," Daleiden told reporters Wednesday. "And this is discriminatory against pro-life Americans and a rally against Californians who happen to have a different point of view."
Becerra, the attorney who brought the charges, is also known for having close ties to Planned Parenthood. He reportedly received thousands of dollars from the abortion giant during his congressional election bids between 1998 and 2014
Even the Los Angeles Times' editorial board called out Becerra for his actions.
"It's disturbingly aggressive for Becerra to apply this criminal statute to people who were trying to influence a contested issue of public policy, regardless of how sound or popular that policy may be," the Los Angeles Times said in a statement. "The state doesn't need to threaten the pair with prison time."

CA Attorney General Under Fire for 'Bogus' Charges Against Pro-life Activists

California's Attorney General is coming under fire for indicting two pro-life activists who recorded undercover videos in their efforts to prove that Planned Parenthood is engaged in illegally selling baby body parts and the criticism is coming from an unexpected source: The Los Angeles Times.
Becerra claimed the pair violated healthcare privacy laws when they made the videos showing Planned Parenthood employees discussing ways to provide the body parts of aborted babies to medical research companies.
"The right to privacy is a cornerstone of California's Constitution, and a right that is foundational in a free democratic society," Becerra said in a statement earlier this week. "We will not tolerate the criminal recording of confidential conversations."
The editorial board called the indictments a "disturbing overreach," said that the law should be applied very narrowly and noted that it has supported such tactics in the past.
"It's disturbingly aggressive for Becerra to apply this criminal statute to people who were trying to influence a contested issue of public policy," they wrote.
The firm cites data from the Center for Responsive Politics that shows that Becerra received more than $5,500 in congressional campaign donations between 1998 and 2014.
Daleiden and Merritt, both with the Center for Medical Progress (CMP), released a series of eight videos in 2015 showing undercover activists discussing the harvesting and pricing of aborted baby body parts with Planned Parenthood and organ procurement firms.
Liberty Counsel says the videos "clearly indicate" illegal activity.
"Each of the Planned Parenthood organizations featured in undercover video recordings released by the Center for Medical Progress clearly indicate the illegal trafficking of aborted baby body parts for profit to three organ procurement organizations, including StemExpress, LLC, Advanced Bioscience Resources, Inc. and Novogenix Laboratories, LLC," reads a statement from the firm.
Although last year's video's kick-started a criminal investigation of Planned Parenthood, no charges were made.
Mat Stave, Founder and Chairman of Liberty Counsel said the indictments of Daleiden and Merrit are a political move.
"The California Penal Code defines murder as the "unlawful killing of a human being, or a fetus, with malice aforethought" and state law requires rendering care to a born-alive infant. Yet, Attorney General Becerra insists on punishing innocent journalists while overlooking the horrors of Planned Parenthood profiting from human genocide. Becerra obviously has his political agenda ahead of the law," he said.
Daleiden agrees with that accusation. He told the Associated Press that the charges against him and Merritt were "bogus." He said that they are coming from "Planned Parenthood's political cronies."
"The public knows the real criminals are Planned Parenthood and their business partners," Daleiden said.
WASHINGTON -- Prominent pro-life speakers took on various issues concerning Planned Parenthood during this weekend's #ProtestPP rallies. Demonstrators gathered at some 200 locations across the nation to protest forced taxpayer funding of the abortion giant.
At a rally in front of a clinic in Orange, California, undercover investigator David Daleiden of the Center for Medical Progress blasted Planned Parenthood for its alleged trade in body parts of the unborn.
"This Planned Parenthood of Orange and San Bernardino County is one of the places – this exact clinic right behind me, this exact mega-center where they do abortions up to six months – this clinic is one of the places where for years and years they have been harvesting and selling the body parts of our unborn brothers and sisters, like so many widgets on an assembly line," Daleiden stated.
Daleiden was part of the undercover investigative team that released shocking videos of Planned Parenthood employees talking about this gruesome practice of harvesting those body parts.
"We now know for almost eight years this Planned Parenthood clinic was partnered with DaVinci Biosciences and DV Biologics up in Yorba Linda, where every week, multiple times a week, their technicians would come into the center and harvest the body parts of late-term aborted children and then re-sell them to make half-a-million dollars every year," Daleiden charged.
He added, "Planned Parenthood knew that this was going on for eight years. They received kickback contributions from DaVinci in exchange for the relationship. And for eight years they used a fraudulent inaccurate consent form to try to coerce their patients to give consent for their body parts to be harvested and sold for profit against the law."
"They are an integral part of the criminal trade in the body parts of our unborn brothers and sisters and they must be held accountable to the law for their barbarism," Daleiden said.
Speaking at a rally in Aurora, Illinois, Jill Stanek of the pro-life Susan B. Anthony List talked about how Planned Parenthood dominates the abortion scene.
She spoke of Planned Parenthood's record of "killing one in three babies in the United States from abortion. Their percentage of abortion increased from 20 percent to 34 percent in just six years."
Stanek also noted that the amount of taxpayer funding going to the abortion giant has soared in recent years.
"I'm sure that this is in line with President Obama being in charge: Planned Parenthood's proceeds from our tax dollars increased by 50 percent since 2007," she said.
At the same rally in Aurora, Eric Scheidler of the Pro-Life Action League blasted Terry O'Neill, president of the National Organization for Women Foundation, for her recent written critique of pro-life health care advocates.
"One of the things she complained about in her article was the website GetYourCare.org," Scheidler told CBN News.
"When someone says, 'Well, how are women going to get their health care?' – they're going to go to GetYourCare.org and they're going to find health care that they need in their community. O'Neill was complaining that that list of health care providers included dentists," he said.
"Some of them are dentists!" Scheidler gasped in a tone of mock outrage, then asked, "Show of hands: Whoever's been to the dentist?"
Every hand at the rally went up.
Then the pro-life leader asked, "Can you go to Planned Parenthood for dental care? No. Can you go to Planned Parenthood for the flu? No. Can you go to Planned Parenthood if you've got a broken leg? No."
He continued, "Can you go to Planned Parenthood if you've got behavioral issues, depression, heart disease, if you've got a problem with sleep, if you've got back pain? One of the most common problems Americans have: back pain. Planned Parenthood? Can't help you."
Referring again to the pro-abortion NOW Foundation president, Scheidler concluded, "Terry O'Neill thinks the only thing a woman needs to see a doctor for is an abortion or maybe some contraceptive pills. Doesn't that show you their mentality?"
"That they would complain we're trying to connect women to dentists along with other kinds of health care," he continued. "We believe in comprehensive health care for Americans. We want to provide that any way we can."
"And that's what GetYourCare.org is about," he concluded. "And that's the difference between the pro-life movement and the pro-death movement."

The last remaining charge against two California pro-life activists has been dropped.
A Texas judge dismissed the tampering with government records charge against David Daleiden and Sandra Merritt, who made undercover videos allegedly implicating Planned Parenthood officials in arranging the illegal sale of fetal tissue to researchers for profit.
Prosecutors claimed Daleiden and Merritt used fake driver's licenses to hide their identities when dealing with Planned Parenthood.
Tuesday, District Judge Brock Thomas dismissed the charge at the request of the Harris County prosecutor's office.
"The dismissal of the bogus, politically motivated charges against CMP project lead David Daleiden and investigator Sandra Merritt is a resounding vindication of the First Amendment rights of all citizen journalists, and also a clear warning to any of Planned Parenthood's political cronies who would attack whistleblowers to protect Planned Parenthood from scrutiny," Daleiden said in a statement.

Defense attorneys said Daleiden and Merritt, activists with The Center for Medical Progress, never should have been indicted.
"Today's dismissal in Houston is a huge win for the First Amendment rights of undercover journalists," Daleiden's attorney, Peter Breen of the Thomas More Society, said in a statement. "David Daleiden used standard undercover journalism techniques and followed all applicable laws in doing so."
"This meritless and retaliatory prosecution should never have been brought. Planned Parenthood did wrong here, not David Daleiden," Breen continued.
"We celebrate this victory for Sandra Merritt as she did nothing wrong," said Mat Staver, founder and chairman of Liberty Counsel, the organization representing Merritt. "She exposed the sale of baby body parts by Planned Parenthood and today she has been vindicated."
"The indictment was politically motivated and should never have been filed in the first place," Staver continued.
Merritt and Daleiden could have been sentenced to up to 20 years in prison if they had been found guilty on the felony charge.
At first, Texas authorities launched a grand jury investigation of Planned Parenthood after the release of the undercover videos last August.
The grand jury ended up clearing Planned Parenthood of misusing fetal tissue and decided to indict Merritt and Daleiden.

House Panel Proves David Daleiden Was Right
At its much-anticipated hearing Wednesday morning, the Select Panel on Infant Lives released a series of exhibits that prove beyond a doubt that Planned Parenthood has been lying to the American people about whether or not it illegally profits from trafficking aborted baby tissue and organs.
Troy Newman, president of Operation Rescue, also served as a founding board member for the Center for Medical Progress, which produced videos exposing the illegal trade. And following the Select Panel's document release, he's speaking out.
"It is clear from the documentation released by the Select Panel that money paid to Planned Parenthood in exchange for aborted baby remains qualified as illegal 'valuable consideration.' This completely validates every allegation that was put forth by investigators from the Center for Medical Progress," he said. "Planned Parenthood has engaged in an aggressive public relations campaign to convince the public that videos released by the Center for Medical Progress were 'hoaxed' and that Planned Parenthood never profited from the sale of fetal remains. Now we all can see for ourselves that this was a bold-faced lie. Planned Parenthood should be prosecuted for their crimes. They must not be held above the law."
The Select Panel exhibits were accompanied by a white paper on the pricing of fetal tissue produced by congressional staff members. The white paper explains how all of the costs of tissue procurement were absorbed by the organ procurement companies, such as Stem Express, and that Planned Parenthood essentially incurred no costs.
The documentation also shows that Planned Parenthood clinics were awarded $10,000 contract signing bonuses by one procurement company that were disguised as donations. Those bonuses were in addition to money paid for POCs—"products of conception," the term Planned Parenthood uses to dehumanize the aborted baby tissue—and blood samples.
For example, four Planned Parenthood clinics in California were paid more than $11,000 in August 2012 for 171 "POCs" and 196 blood samples harvested at their facilities. A review of a tissue procurement company's website shows a list of organs that were available for sale, including brains, hearts, livers, glands and even scalps.
The Center for Medical Progress, Operation Rescue and the Select Panel all agree these organs had to be procured from abortion facilities like Planned Parenthood.
"Now you do not have to be a lawyer to see what's going on here," Rep. Marsha Blackburn (R-Tenn.), Chairman of the Select Panel, said. "You put up a website that offers any baby body part imaginable—and why on earth do they need a baby scalp? Then you pick the gestation period and then check out."
Newman said the answer to Blackburn's question is "grisly."
"Tissue wasn't just being used for 'medical' research but by commercial entities for the use in the development of products for sale to the public," he said. "The male hair growth industry is a very lucrative one."

WASHINGTON -- Supporters rallied outside the Harris County courthouse as indicted pro-life activist David Daleiden rejected a probation deal and announced plans to take on the district attorney in court next month.
Daleiden faces a second degree felony charge that could land him in prison for 20 years for using fake identifications to uncover Planned Parenthood's harvesting of unborn baby parts.

Daleiden rejected the disctrict attorney's deal and will instead go before the court March 28. His attorneys say the only thing they will accept from Harris County District Attorney Devon Anderson is an apology.
"This D.A.'s office needs to apologize to David for dragging him down here and making him have to defend himself when the actual wrongdoers are not here today," they said.
"David is a modern-day hero. He has exposed something that has been occurring in abortion clinics all across this country and the fact that he is here today is a miscarriage of justice," they said. "And we believe once this case is done it will be dismissed, it will be thrown out, and we are hopeful that this D.A. will go after the real wrongdoer: Planned Parenthood."
Daleiden's defense attorneys argued that his actions were "fully within the tradition of undercover journalism" and the indictment was really intended to scare modern-day journalist from exposing the truth.
The attorney said additional incriminating information about the abortion provider will be presented to the district attorney.
Meanwhile, the courthouse was flooded with pro-life advocates who joined Daleiden at a press conference earlier Thursday.
Pro-life activist Rev. Patrick Mahoney condemned Anderson for "using her office for a politically motivated agenda."
"This is the only grand jury in America where someone was indicted for a fake drivers license. But its not a fake drivers license because their intent as journalists was to get to the truth," Mahoney said. "The fact that Devon Anderson has gone after them is really an embarrassment to this county."
"From their efforts over 12 states began their investigations of Planned Parenthood themselves. Numerous states voted to defund Planned Parenthood because of what David Deleiden and Sandra Merritt did," Mahoney explained.
"For the first time in history a bill went to a sitting president of the Untied States to defund Planned Parenthood. That's never happened in history before. All based on the work that David and Sandra did. This has lead to the most major expose of Planned Parenthood," he continued.
At the press conference, Daleiden also expressed his immense gratitude for the support and prayers he and Merritt recieved.
"I think we all know that every day that goes by the Texas authorities do not prosecute Planned Parenthood for their illegal trade of baby parts, they are sending a message to the entire country that the state of Texas is open right now for the sale of baby body parts," he said.
"But by your presence today you are all sending an equally strong message, if not stronger message, that the children of Texas and the children of Houston's body parts are not for sale," he said.
Mahoney showed supporters the 110,000 signatures from petitioners who demand the charges be dropped against two activists.
The signatures will be presented to Anderson. If she does not drop the charges, Mahoney said they will file charges against her for "ethical violations."
"If she still insists... we will do everything we can in our power to ensure that Houston has a new district attorney that respects justice and jails criminals and not citizen journalists," he concluded.
A prayer vigil for Daleiden and Merritt and their attorneys also followed the press conference as they continue to face the history-making legal battle.
The Center for Medical Progress has released a new video detailing how Planned Parenthood used bogus line-item entries to hide profits from the sale of aborted baby remains.
The video focuses on invoices obtained by Operation Rescue's Texas attorney Briscoe Cain through Freedom of Information Act requests, and it connects the dots to Planned Parenthood's duplicitous book-keeping scheme with clips from the CMP's undercover investigation at the Houston Planned Parenthood, one of the largest volume late-term abortion facilities in the country.
"The invoices clearly show how Planned Parenthood padded invoices in such a way as to hide the fact they were making illegal profits," said Operation Rescue Senior Vice President Cheryl Sullenger. "This is not only hard evidence that Planned Parenthood broke the law, but also shows that The Harris County grand jury indicted the wrong people."
A Harris County Grand Jury recently indicted CMP leader David Daleiden and his associate, Susan Merritt, who conducted the on-site undercover sting in Houston. While the same grand jury is said to have "cleared" Planned Parenthood, Operation Rescue has uncovered evidence that bias in the office of District Attorney Devon Anderson tainted the process and turned the investigation against the whistle-blowers who reported evidence of Planned Parenthood's obvious criminal conduct.
Daleiden and Merritt will turn themselves in at the Harris County Courthouse on Thursday when a press conference by national leaders will present over 100,000 signatures calling on Anderson to drop the charges against Daleiden and Merritt.
Operation Rescue President Troy Newman served as a founding Board Member for the Center for Medical Progress. He, along with Daleiden and others, have been sued in a San Francisco Federal Court by Planned Parenthood and the National Abortion Federation, who are attempting to use the courts to silence the evidence against them and deflect public attention from their own wrongdoing.
"We call on District Attorney Devon Anderson to resign due to her inability to conduct her duties without bias," said Sullenger. "We also call for all charges to be dropped against Daleiden and Merritt and for special prosecutors to reopen the Planned Parenthood and Karpen cases."
Houston abortionist Douglas Karpen was accused by former employees of murdering babies who were born alive during late-term abortions, but was "cleared" by another Anderson grand jury in 2013. Karpen was represented by attorney Chip Lewis, who is a personal friend of Anderson's and is her largest political donor. Lewis recently indicated he has improper inside knowledge of both grand juries.

Two anti-abortion activists behind the filming of videos on fetal tissue procurement by Planned Parenthood were indicted by a Texas grand jury on Monday, while clearing the women's health group of any wrong-doing.
The videos released last summer led Texas and other Republican-controlled states to try to halt funding for local Planned Parenthood operations, with Republicans in the U.S. Congress also pushing for a funding cut.
The grand jury reviewed the case for more than two months and its decision was a result of a probe launched last year under Texas Governor Greg Abbott, a Republican, who accused Planned Parenthood of the "gruesome harvesting of baby body parts."
"After a lengthy and thorough investigation by the Harris County District Attorney's Office, the Texas Rangers, and the Houston Police Department, a Harris County grand jury took no action Monday against Planned Parenthood Gulf Coast," the Harris County District Attorney's office said in a statement.
Planned Parenthood has denied the accusation and called the probe politically motivated.
David Daleiden and Sandra Merritt were indicted by the grand jury for tampering with a governmental record, said prosecutors for the county in which Houston is located. The felony charge is punishable by up to 20 years in prison.
The two were involved in covert videos last year in which a Planned Parenthood official discussed the procurement of fetal tissue.
Daleiden, leader of the Center for Medical Progress that released the videos, was also charged with violating a prohibition on the purchase and sale of human organs, a misdemeanor, the Harris County District Attorney said.
There were no details released on the allegations against them.
"I respect their decision on this difficult case," Harris County District Attorney Devon Anderson said of the grand jury.
The videos purported to show Planned Parenthood officials trying to negotiate prices for aborted fetal tissue. Under federal law, donated human fetal tissue may be used for research, but profiting from its sale is prohibited.
"These people broke the law to spread malicious lies about Planned Parenthood in order to advance their extreme anti-abortion political agenda," said Eric Ferrero, vice president of Communications for Planned Parenthood Federation of America.
It is unclear what triggered the surprise indictments during the grand jury's closed-door proceedings, said David Sklansky, faculty co-director of the Stanford Criminal Justice Center and a professor at Stanford Law School.
"It would be quite unusual for the grand jury to change direction without the cooperation and approval of the prosecutor," Sklansky said. "But pretty much everything associated with this case seems unusual."
Republican presidential candidate Mike Huckabee weighed in, saying in a statement: "It's a sick day in America when our government punishes those who expose evil with a smartphone - while accommodating those who perform it with a scalpel."
Texas leaders said they would not back down on their probe.
Arkansas and Louisiana, two neighboring states that have launched similar moves to cut state Medicaid funding after the videos, have been on the losing end of federal lawsuits, with judges blocking their attempts to halt funds.

New Video Reveals Baby Harvesters 'Take What They Wanted and the Mothers Don't Know'

The second episode in a new documentary web series highlights a young woman's eyewitness narrative of the daily practice of fetal body parts harvesting in Planned Parenthood abortion clinics, describing tissue procurement, workers' coordination with abortion providers, the pressure placed on patients, and disregard for patient consent.
The "Human Capital" documentary web series, produced by The Center for Medical Progress, integrates expert interviews, eyewitness accounts, and real-life undercover interactions to explore various themes connected to Planned Parenthood's sale of aborted fetal tissue. Episode 1, "Planned Parenthood's Black Market in Baby Parts," premiered last month. Episode 2, "Inside the Planned Parenthood Supply Site," launched this week.
The series follows the personal narrative of Holly O'Donnell, a former Blood and Tissue Procurement Technician for StemExpress, a start-up biotech company from northern California that partners with Planned Parenthood clinics to purchase their aborted fetus parts and resell them for scientific experimentation. As a procurement tech, O'Donnell's job was to identify pregnant patients matching the specifications of StemExpress customers and to harvest the fetal body parts from their abortions.
"It's not an option, it's a demand," StemExpress supervisors instructed O'Donnell about approaching pregnant women at Planned Parenthood for fetal tissue "donations." O'Donnell says the StemExpress techs working in Planned Parenthood clinics sometimes harvested fetal parts without obtaining consent from the patients: "If there was a higher gestation, and the technicians needed it, there were times when they would just take what they wanted. And these mothers don't know. And there's no way they would know."
Federal laws on the procurement and use of human fetal tissue require that patients consent to the tissue donation subsequent to consenting to the abortion procedure (42 U.S.C. 289g-1).
According to O'Donnell, Planned Parenthood gave StemExpress workers access to patient records and schedules so that the harvesting company could plan for the days when patient "supply" would be greatest. "They give you a sheet, and it's everybody for that day, who's coming in for an ultrasound, who's coming in for an abortion, medical or a late-term abortion," O'Donnell explains. Even patients just seeking a pregnancy test at Planned Parenthood were considered part of the supply: "Pregnancy tests are potential pregnancies, therefore potential specimens. So it's just taking advantage of the opportunities."
Project Lead David Daleiden notes, "Experiences like Holly O'Donnell's show that Planned Parenthood's abortion and baby parts business is not a safe place where vulnerable women can be cared for, but a harvesting ground for saleable human 'product.' Taxpayer subsidies to Planned Parenthood's barbaric abortion business should be revoked immediately, and law enforcement and other elected officials must act decisively to determine the full extent of Planned Parenthood's offensive practices and hold them accountable to the law."
